 FUSION BREAKS BOOKING TERMS & CONDITIONS

1. Making Your Booking
A binding contract between us comes into existence as soon as we receive you on-line booking form. By making your booking with us, you will be regarded as having read and understood our Terms and Conditions.  You must be over 18 to book an event or activity break with us.  You must check all details of the event or activity break carefully before you submit your booking form.
 
2. Making Your Payment
Full payment must be made 8 weeks prior to the date of the event or activity break.  Payment may be made online by credit card or debit card (subject to a 2% surcharge), or via bank transfer (this option can be chosen at the on-line checkout).  Once the on-line booking form and full payment are received we will email you confirmation of the booking which will also serve as your receipt.
 
3. If You Want To Transfer Your Booking To Another Event or Activity Break
If you wish to alter or transfer your booking, we will try our best to do this but it may not always be possible.  You must e-mail us with details of the alteration 4 weeks prior to the event or activity break.   Any alteration made by you with less than 4 weeks notice will be treated as a cancellation of the original booking and will be subject to the cancellation charges set out in Clause 4.  Please note that we cannot offer to transfer your booking if it is for one of our breaks outside the UK.
 
4. If You Want To Cancel Your Event Booking
You must email us immediately if you need to cancel your booking.  You should ensure you are adequately insured for circumstances that may lead to your cancellation.  Our cancellation charges are set out below and depend on how much notice you give us prior to the commencement of the event or activity break you have booked:
For Breaks in the UK
0-21 days notice = 100% of the total cost of the event or activity break
22-28 days notice = 70% of the total cost of the event or activity break
29-35 days notice = 50% of the total cost of the event or activity break
36 days or more = 20% of the total cost of the event or activity break 

For Breaks outside the UK
0-36 days notice = 100% of the total cost of the event or activity break
37-65 days notice = 70% of the total cost of the event or activity break
66-89 days notice = 50% of the total cost of the event or activity break
90 days or more = 20% of the total cost of the event or activity break 
Depending on the reason for cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of your insurance policy. Claims must be made directly to the insurance company concerned.
In some circumstances, and providing you give us more than 14 days notice for a UK break or 36days notice for a break outside the UK, we may be able to transfer the booking to another person introduced by you.  This cannot always be guaranteed as it will depend on a variety of factors including if there are any other people on the reserve list (as places must be offered to them first) and the age and gender of the person you wish to replace you. However, please ring or email us as soon as possible and we will try our best to help you.
5. If We Change Your Booking 
Please note that actual itineraries are often subject to prevailing weather conditions and therefore may need to be changed.  We may also occasionally have to change your event or activity break arrangements or part of them, and must reserve the right to do so at any time. Most alterations are minor and should not affect your enjoyment of the event or activity break.  In the case of minor alterations, we will do our best to notify you beforehand. 
If we have to make major alterations, such as a significant change of location, change of date, or change of accommodation to that of a lower standard, we will notify you as quickly as possible. You may then:
a) accept the changed arrangements
b) accept an alternative event or activity break subject to availability. If the alternative event or activity break is of a lower price than that originally confirmed, the difference will be refunded to you.  If the alternative is more expensive, you will need to pay the difference or
c) withdraw from the booking completely in which case we will make a full refund
We regret that compensation will not be payable if we have to make a significant change due to reasons of force majeure, see clause 10.
6. If We Cancel Your Booking
Very rarely, cancellation may be necessary and we reserve the right at our absolute discretion to cancel your event or activity break at any time. If this occurs, you will be offered; an alternative holiday of comparable standard (if available) together with a refund of any price difference, or a full and prompt refund (except where the cancellation is due to reasons of force majeur, see clause 10).
7. Special Requests
If you have any special request, you must advise us by email at the time of booking. Although we will pass any reasonable requests on to the relevant supplier, we regret we cannot guarantee any request will be met unless we have specifically confirmed it.
8. Complaints
If you have any complaint during your event or activity break, please inform the host or local representative/supplier immediately so that action can be taken to remedy the situation.  If you are still not happy with their response please email us within 28 days of your return with full details of your complaint.  We will acknowledge your complaint within 7 days and provide a full response within 28 days.
 
9. Minimum Numbers
Each of our events and activity breaks are based on a minimum number of participants and we reserve the right to cancel if such numbers are not reached. You will then have the choice of booking an alternative event or activity break with us, or a full refund.
10.   Force Majeure
Except where otherwise stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of "force majeure". In these Booking Conditions, "force majeure" means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, terrorist activity or actual threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.
11. Inappropriate Behaviour
We expect all clients to have consideration for other people. If in our reasonable opinion or in the reasonable opinion of any other person in authority, your behaviour is causing danger, damage or affecting the enjoyment of others, we reserve the right to terminate your event or activity break. Such individuals may also be liable for prosecution.  We take no responsibility for any additional expenses incurred or loss of activity event or break by individuals in any such circumstances.  We cannot accept responsibility for the actions of people outside of our control.
When you book with us, you accept responsibility for any damage or loss you cause during your event or activity break.  Full payment for any such damage or loss must be paid direct at the time to the accommodation owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and the other party's full legal costs) as a result of your actions.
12.  Your Health and Fitness
In order to take part in sporting activities, all persons should be in good health and possess a reasonable basic level of fitness. If you wish to partake in any water sports you must be able to swim at least 25 metres.   We will not provide any refunds or compensation or pay any expenses which you may incur as a result of you not being fit enough or well enough to participate in our events or activities. You must advise us prior to your event or activity break of any disability, medical or behavioural problem you experience which may affect your participation or that of any other guests on the activity break or event. 
Please note: some of the activities we offer (for example but not limited to White Water Rafting, Rock Climbing, Kayaking, Mountain Biking or Cycling, Hiking, Abseiling, Canoeing,  Tubing, Watersports, Sailing, or similar), carry their own inherent risks and by booking such activities you acknowledge that you are exposing yourself to such risks for which you need to have adequate insurance, claims against Suppliers providing acitivities must be made to the Supplier direct.
 
13.  Fusion Breaks Gift Vouchers
Fusion Breaks Gift Vouchers are available from our on-line store.  Once purchased you will receive a separate email with a single-use voucher code.  All you need to do is forward the email containing the voucher code on to the person who you want to receive the gift voucher. The recipient can then use the voucher code when purchasing one of our breaks.  Gift vouchers can be used against any of our singles or general breaks and can be used in conjunction with other offers.  Please note gift vouchers must be redeemed within 12 months from the date of purchase.
